These Product Terms of Service (“Terms”) govern your use of:
The Curiosity Desktop App (free and paid versions), and
The Curiosity Developer Workspace (free evaluation version).
These Terms form a binding agreement between you and:

If you do not agree to these Terms, you may not use the software.
Scope
These Terms apply to:
Individual users of the Curiosity Desktop App
Paid subscribers of the Desktop App
Users of the Developer Workspace
Cloud and Enterprise Workspaces are governed by separate Enterprise Terms.
License Grant
Subject to these Terms, Curiosity grants you a non-exclusive, non-transferable, non-sublicensable license to install and use the software for your own internal purposes.
The Developer Workspace is provided for testing and evaluation purposes only and may not be used in production environments.
The software is licensed, not sold. All rights not expressly granted are reserved by Curiosity.
Acceptable Use
You may not:
Reverse engineer, decompile, or attempt to derive source code, except where permitted by law
Circumvent technical restrictions
Use the software for unlawful purposes
Use the software to develop a competing product
You are responsible for complying with applicable laws when using the software.
AI Features
Certain features may use third-party AI model providers to generate responses. When you actively use such features, content you submit (such as prompts or selected text) may be transmitted to these providers for processing.
AI-generated output may be inaccurate or incomplete. You are responsible for reviewing and verifying any output before relying on it.
Curiosity does not use your content to train artificial intelligence models.
Your Data
You retain all rights to the data you process using the software.
For the Desktop App and Developer Workspace, documents and files are processed locally on your device or within your environment by default. Curiosity does not receive or store your workspace content on its servers unless you explicitly use features that require external processing (such as AI features).

Desktop App Subscriptions
The Desktop App may be offered in free and paid versions.
Paid subscriptions:
Are billed on a recurring basis as selected at purchase
Renew automatically unless cancelled
Can be managed and cancelled through your account at accounts.curiosity.ai
Take effect at the end of the current billing period when cancelled
Fees are non-refundable unless required by law.
Updates and Changes
We may provide updates, improvements, or modifications to the software. We may discontinue or modify features, including AI features, at any time.
Termination
You may stop using the software at any time. We may suspend or terminate access if you materially breach these Terms. Upon termination, your license ends and you must stop using the software.
Warranty Disclaimer
The software is provided “as is”. We do not guarantee that the software will be uninterrupted, error-free, or suitable for your specific purposes. Mandatory statutory rights remain unaffected.
Liability
Curiosity is liable without limitation for:
Intentional misconduct
Gross negligence
Injury to life, body, or health
Liability under mandatory statutory law
For simple negligence, Curiosity is liable only for breaches of essential contractual obligations and limited to foreseeable damages typical for this type of agreement.
For paid Desktop subscriptions, total liability is limited to the fees paid in the twelve (12) months preceding the event giving rise to the claim.
For the free Desktop version and Developer Workspace, liability for simple negligence is limited to typical foreseeable damages.
Governing Law and Jurisdiction
These Terms are governed by the laws of Germany. If you are a merchant or legal entity under public law, exclusive place of jurisdiction is Munich, Germany. If you are a consumer, mandatory statutory provisions of your country of residence remain unaffected.
Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the invalid provision.
Changes to These Terms
We may update these Terms from time to time. The current version is available on our website. Continued use of the software after an update constitutes acceptance of the revised Terms.
